Terms of Sale and Licence

These are the terms for buying and using EachPayday. We have kept them short and in plain language. Nothing here removes or limits your rights under the Australian Consumer Law.

1. Who you are buying from

EachPayday is made by O'Connor Digital Marketing (ABN 11 784 527 097), a sole trader business operated by Nate O'Connor, based in Queensland, Australia ("we", "us", "our"). Stripe acts as merchant of record and reseller for the purchase transaction, through its Managed Payments service: Stripe processes your payment, collects and remits GST where it applies, issues your receipt, and manages the payment transaction under Stripe's buyer terms. The purchase is presented through Link, Stripe's consumer payments service, and the merchant of record entity is Stripe's affiliate Sold through Link, LLC, so your receipt comes from Link and the purchase shows as Sold through Link. Separately, your purchase entitles you to a licence from O'Connor Digital Marketing to use EachPayday under these Terms of Sale and Licence. Your payment details go to Stripe, never to us.

In short: the payment transaction is with Stripe; the software licence is with us.

2. What EachPayday is

EachPayday is a local-first budgeting app for organising your money around your pay cycle. It runs on your own devices, works offline, and stores your data only on the device where you use it.

Two properties of the product matter enough to state in the terms:

  • Your data lives on your devices, not our servers. We have no copy of your budget. Backing up with the app's export feature is your responsibility, and restoring from your backup file is the only way to recover data if a device is lost or its browser storage is cleared.
  • Data does not sync live between devices. Each install keeps its own separate copy. The export and restore feature moves your budget between devices; it is a backup tool, not a live sync. Buy EachPayday on the understanding that live sync is not a current feature.

3. Try before you buy

The app includes a free, unlimited demo mode ("Explore with sample data") that shows every feature with a full example household. We provide it precisely so you can satisfy yourself the app suits you before paying. Using your own figures requires a licence.

4. Price and payment

The price is shown on eachpayday.com.au at the time of purchase, in Australian dollars, inclusive of GST where it applies. Waitlist members receive the launch price. A permanent concession price is available on an honour basis; no proof is required. Payment is processed by Stripe as merchant of record (section 1), under Stripe's terms for buyers, and your card statement will show a charge from LINK.COM* EACHPAYDAY (Link is the Stripe service that presents the purchase, see section 1; your bank may shorten the text).

5. Delivery

Your licence key is delivered by email after purchase, together with instructions for activating it in the app. If your key does not arrive within a reasonable time, email hello@eachpayday.com.au and we will sort it out.

6. Your licence

Your purchase gives you a personal, non-transferable licence to use EachPayday. The licence is per household: you may activate it on your own devices, and your partner or family members living in the same home may use it too. That is deliberate; one home, one licence.

To keep the product fair for everyone:

  • The licence covers a reasonable number of activations, enough for your own devices. If you genuinely hit the limit, contact us and we will help.
  • The app displays the licence holder's name and partially masked email in Settings.
  • You must not publish, resell, or share your licence key outside your household. We may use reasonable technical measures to enforce licence limits and prevent misuse, and we may suspend or revoke a key after reasonable investigation, where we reasonably believe it has been shared publicly. Suspension or revocation for misuse does not affect your statutory rights in respect of your original purchase.

You may not reverse engineer, copy, modify or redistribute the app except where the law permits it despite this clause.

Our intellectual property. EachPayday, including its software (source code and object code), user interface design, branding, documentation and all written content on our websites and in the app, is protected by copyright and other intellectual property laws, and all of it remains ours. These protections apply to everyone, not only licence holders: copying, republishing, rebranding or reselling EachPayday or any substantial part of it without our written permission is prohibited whether or not you have ever bought a licence, and we will enforce our rights.

7. Updates

All updates within version 1.x are included free with your licence: bug fixes, improvements and new 1.x features. The app updates itself when a new version is published; your data is untouched by updates.

If we ever release a major version 2, it may be an optional paid upgrade. Your 1.x licence and app will keep working; you will never be forced to pay again to keep what you bought.

8. Your Australian Consumer Law rights

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those consumer guarantees.

If EachPayday has a major failure, you are entitled to your choice of a refund or replacement, and compensation for any other reasonably foreseeable loss or damage. If the failure is not major, we are entitled to fix it within a reasonable time, and if we do not, you are entitled to a refund.

If you believe you are entitled to a refund or other remedy under Australian Consumer Law, please contact us first so we can assess and resolve the issue. To make a claim, email hello@eachpayday.com.au with your purchase details and a description of the problem. Where a refund is approved, it will normally be processed through Stripe using the original payment method.

9. Change-of-mind refunds

We do not offer refunds for change of mind. The unlimited demo mode exists so you can try the entire app before paying, and we encourage you to use it. This policy does not limit your Australian Consumer Law rights in section 8 in any way.

10. Liability

To the extent permitted by law, and without limiting section 8:

  • EachPayday is provided for use as a self-directed budgeting tool. We are not liable for financial decisions you make using it.
  • Because your data is stored only on your devices and your backups are under your control, we are not liable for data loss caused by device loss, cleared browser storage, or failure to keep backups. The app provides export tools and prompts to make backups easy. This exclusion does not apply to data loss caused by a defect in EachPayday itself, and nothing in it limits your rights under section 8.
  • Our total liability for any claim connected with EachPayday, other than liability that cannot be limited under the Australian Consumer Law, is limited to the amount you paid for your licence.

11. Not financial advice

EachPayday is a self-directed tool and general information. It does not provide financial advice, does not consider your personal circumstances, and does not tell you what to do with your money. 12. Ending these terms

These terms apply for as long as you use EachPayday. We may terminate your licence if you materially breach these terms (for example, public key sharing under section 6) and the breach is not remedied after we contact you. Sections that by their nature should survive (sections 8, 10 and 13) survive termination.

13. General

These terms are governed by the laws of Queensland, Australia. If any part of these terms is found invalid, the rest remain in effect. We may update these terms for future purchases; the terms in force when you buy are the ones that apply to your purchase.
